By accessing or using ByteArmor ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you do not have permission to access the Service.

ByteArmor reserves the right to update and change these Terms at any time without notice. Continued use of the Service after any such changes constitutes your acceptance of the new Terms.

2. Description of Service

ByteArmor provides AI-powered security code review and vulnerability detection services for software repositories. The Service includes:

Automated vulnerability scanning of source code
AI-powered security analysis using Large Language Models
Integration with GitHub repositories
Vulnerability reports and remediation guidance
Dashboard analytics and security insights

3. Account Registration and Security

3.1 Eligibility

You must be at least 13 years old to use this Service. By registering, you represent and warrant that you meet this age requirement. ByteArmor is available globally with no geographic restrictions.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to immediately notify ByteArmor of any unauthorized use of your account.

3.3 GitHub Integration

By connecting your GitHub account, you authorize ByteArmor to access your repositories according to the permissions you grant through GitHub's OAuth process.

4. Subscription Plans and Billing

4.1 Plans

ByteArmor offers different subscription tiers (Free, Pro, Max) with varying features and limits as described on our pricing page.

4.2 Payment

Paid subscriptions are billed monthly or annually in advance. All payments are processed through Stripe.

4.3 Refund Policy

We offer a 3-day refund policy from the date of purchase. To request a refund within this period, contact [email protected]. After 3 days, all payments are non-refundable.

4.4 Plan Limits

Each plan has specific limits on:

Number of scans per month/day
Number of private repositories
Number of files per scan
API access and rate limits

Exceeding these limits may result in service suspension until the next billing period or upgrade to a higher plan.

5. Acceptable Use Policy

You agree NOT to use ByteArmor to:

Scan code you don't own or have explicit permission to analyze
Attempt to discover vulnerabilities in third-party systems without authorization
Upload malicious code or malware
Attempt to reverse engineer, decompile, or hack the Service
Use the Service for any illegal or unauthorized purpose
Violate any laws in your jurisdiction
Share your account with others or resell access to the Service
Circumvent any rate limits or access restrictions
Use automated systems or bots to access the Service beyond our official API
Submit false, misleading, or fraudulent information

Violation of this Acceptable Use Policy will result in immediate account termination without refund.

6. Intellectual Property Rights

6.1 Your Content

You retain all rights to the code and content you submit for scanning. ByteArmor claims no ownership over your source code.

6.2 Scan Results

You retain full ownership of all scan results and vulnerability reports generated by ByteArmor. These are your property and you may export, share, or use them as needed for your security and compliance purposes.

6.3 Data Export

You have the right to export all your data including scan results, vulnerability reports, and account information at any time through the dashboard or by contacting support.

6.4 ByteArmor Property

The ByteArmor service, including its original content, features, and functionality, remains the exclusive property of ByteArmor and is protected by international copyright, trademark, and other intellectual property laws.

7. Data Privacy and Security

7.1 No Training on Your Data

ByteArmor and our AI model providers (Meta Llama, OpenAI) do NOT use your code, prompts, or scan results to train AI models.

7.2 Data Protection

We implement industry-standard security measures including:

Encryption at rest and in transit
Strict access controls
Regular security audits
Compliance with data protection regulations

7.3 No Data Sales

We do not sell, trade, or rent your personal information or code to third parties.

8. Service Availability and Modifications

8.1 Availability

While we strive for 99.9% uptime, ByteArmor is provided "as is" without any guarantees of continuous availability. We reserve the right to modify, suspend, or discontinue the Service at any time.

8.2 Updates

We may update the Service with new features, improvements, or changes that may affect how you use ByteArmor. We'll notify you of significant changes via email or in-app notifications.

9. Disclaimers and Limitations of Liability

9.1 No Warranty

ByteArmor is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied. We do not guarantee that the Service will detect all vulnerabilities or that detected vulnerabilities represent all security issues in your code.

9.2 Limitation of Liability

In no event shall ByteArmor be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or use, arising from your use of the Service.

9.3 Security Advisory

ByteArmor is a tool to assist in identifying potential vulnerabilities. It is not a replacement for comprehensive security audits, penetration testing, or professional security consulting.

10. Account Termination

10.1 By You

You may cancel your account at any time through the account settings or by contacting support. Cancellation takes effect at the end of the current billing period.

10.2 By ByteArmor

We reserve the right to suspend or terminate your account immediately, without prior notice or liability, for any reason, including:

Violation of these Terms
Violation of our Acceptable Use Policy
Non-payment of fees
Fraudulent or illegal activity
Actions that harm or could harm ByteArmor, other users, or third parties

Upon termination, your right to use the Service will immediately cease. Your data, including all scan results and vulnerability reports, will be immediately and permanently deleted from our systems. We recommend exporting any important data before account termination.

11. Indemnification

You agree to indemnify and hold harmless ByteArmor and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Delaware, without regard to its conflict of law provisions. You agree to submit to the personal jurisdiction of the courts located in Delaware.
